Probate & Guardianship
Probate is the process of transferring assets from a deceased person to their beneficiaries or heirs. An experienced probate attorney can help ensure that the deceased’s assets are distributed according to his or her wishes.
If the deceased’s estate needs to go through probate, the next question is whether he or she had a will. If so, the distribution of assets will generally take place under the terms of the will. If there is no will, Oklahoma law will govern how assets will be distributed.
We handle a broad range of probate and estate issues for our clients, focusing on providing them with the relief and peace of mind that comes with successfully resolving their probate and estate administration issues.
Our practice is focused on representing personal representatives and beneficiaries in the probate process and preparing estate tax returns. We also engage in post-mortem planning to minimize estate taxes.
Circumstances arise where a guardianship proceeding is helpful or needed when incapacity exists or even where an estate plan is in place – such as where exploitation risks exist. The attorneys of Pray Walker have a great deal of experience in navigating the risks that are raised by and the many issues to be addressed in guardianship proceedings.
